CANADA IMMIGRATION

EXPRESS ENTRY

Express Entry is the new selection system for Canadian immigration, designed to select skilled workers for immigration to Canada. Express Entry is a completely electronic process involving the federal government, provincial governments, and Canadian employers. This system is effective from January 2015 and through this system Citizenship and Immigration Canada (CIC) manage applications for permanent residence under certain economic immigration programs.

Actually, Express Entry is not an immigration program in itself, but rather a modern online system to select candidates for immigration to Canada using the economic immigration programs including Federal Skilled Worker Program, Federal Skilled Trades Program and Canadian Experience Class Program.

Potential candidates are required to complete their online profiles as a first step to immigrate to Canada under the Express Entry Program. Unlike policy in the past, there are no deadlines to submit the application/express entry profile or quotas applied to the number of applicants that could be accepted to the Express Entry Pool.

PROVINCIAL NOMINEE PROGRAM

There are 10 provinces and 3 territories in Canada. Most provinces and territories in Canada can nominate immigrants through the Provincial Nominee Program (PNP). These immigrants must have the skills, education and work experience to contribute to the economy of that province or territory, and must want to live there.

Each province and territory has its own “streams” (immigration programs that target certain groups) and criteria for their PNP. SELF EMPLOYED

Canada’s Self-Employed Persons Program seeks to bring people who will become self-employed in Canada. They must have either: relevant experience in cultural activities or athletics, and intend and be able to make a significant contribution to the cultural or athletic life of Canada, or experience in farm management, and intend and be able to buy and manage a farm in Canada.

To be eligible as a self-employed person, you must: have relevant experience, and intend and be able to be self-employed in Canada, meet the selection criteria for self-employed people, and meet medical, security and other conditions.

Your experience is relevant if you have: taken part in cultural activities or athletics at a world-class level, been self-employed in cultural activities or athletics, or experience in managing a farm.

SKILLED TRADE PROGRAMS

Federal skilled trades class (FSTC), under Express Entry is Immigration, Refugees and Citizenship Canada’s (IRCC’s) system for managing the intake of economic immigration applications submitted on or after January 1, 2015.

Under this program foreign nationals must receive an invitation from IRCC before they may apply to Federal Skilled Trades program. This eliminates the requirement to process applicants in these programs through a first in, first out method. IRCC aims to process 80% of complete Express Entry applications in six months or less.

In Express Entry, foreign nationals wishing to come to Canada must first complete a profile through their online account. Those who appear to meet the criteria of one or more of the three federal immigration programs managed through Express Entry (i.e., FSWC, FSTC and CEC) are automatically entered into the Express Entry pool of candidates. Top-ranked candidates are then invited to apply online for permanent residence.

IMMIGRANT INVESTORS

Investor program is for you if you are an international investor with the skills and abilities needed to contribute to Canadian economy and integrate into the society. You may be eligible to apply for permanent residence under the Immigrant Investor Venture Capital (IIVC) Pilot Program.

You must have a personal net worth of CDN $10 million or more. Your net worth must have been acquired through lawful, private sector business or investment activities.

If you are one of the immigrant investors approved under this program, you will be required to enter into an agreement with CIC committing a sum of CDN $2 million to the IIVC Fund for approximately 15 years.

CARE GIVERS

In order to qualify as a caregiver in Canada, all applicants must meet the requirements set by Citizenship and Immigration Canada (CIC) under the foreign caregiver program. The Live-in Caregiver Program allows professional caregivers to work in Canada. Caregivers are individuals who are qualified to work without supervision in a private household providing care for children, elderly persons or people who have disabilities.

The new rules require an employer to obtain a positive Labour Market Impact Assessment in order to hire a caregiver from abroad. The LMIA is needed to prove that hiring of a foreign worker is necessary due to a shortage of locally available caregivers.

There are four main requirements to qualify under the Live-in Caregiver Program:

1. You must have successfully completed the equivalent of a Canadian high school education.

2. You must have six months of full-time training in a classroom setting or twelve months of full-time paid employment, including at least six months of continuous employment with one employer in a field or occupation related to the job you are seeking, as a live-in caregiver. You may have gained your training or experience in areas such as early childhood education, geriatric care, pediatric nursing or first aid. You may also have completed your training as part of your formal education. This experience must have been obtained within the three years immediately prior to the day on which you submit an application for a work permit.

3. You must be able to speak, read and understand either English or French at a level that allows you to function independently in a home setting.

4. You must have a written employment contract between you and your future employer.

CANADA VISA

Now almost everyone needs a visa to enter Canada. Even national of those countries which were exempt from visa to enter Canada are required to get an Electronic Travel Authorization (eTA) even if they are to transit through Canada. Exceptions include U.S. citizens and travelers with a valid Canadian visa. Canadian citizens, including dual citizens, and Canadian permanent residents cannot apply for an eTA.

As regards immigration to Canada Federal and Provincial governments of Canada are constantly improving their immigration programs to welcome an increased number of immigrants through economic programs and family sponsorship.

SUPER VISA

It is a long-term, multiple-entry visa for parents and grandparents of permanent residents or Canadian citizens. The Parent and Grandparent Super Visa (Super Visa) is a temporary resident permit that allows parents and grandparents to stay for up to 2 years in Canada per visit. It is valid for up to 10 years. To apply for the parent and grandparent super visa, you must: be the parent or grandparent of a Canadian citizen or a permanent resident of Canada, be allowed to enter Canada and meet certain other conditions.

Immigration officers consider several things before they decide if you can come to Canada. You must be a real visitor to Canada who will leave by choice at the end of your visit. An officer will look at these things when you apply (1) your ties to your home country (2) the purpose of your visit (3) your family and finances (4) the overall economic and political stability of your home country, and (5) an invitation from a Canadian host.

FAMILY SPONSORSHIP

If you are a Canadian citizen or a permanent resident living in Canada, and you can sponsor close family members living abroad, including children adopted outside of Canada or who will be adopted in Canada, or brother, sisters, nephew, niece or grandchild who are orphaned, under 18 and not married or in a common-law relationship. If you are related to the person you want to sponsor in another way, you could still sponsor him/her if you do not have a member of the Family Class to sponsor.

Once you are approved as a sponsor, the person you are sponsoring can begin the process of their permanent residence application. If you are a Canadian citizen adopting a child from another country, you can apply for Canadian citizenship for your adopted child right away. You do not have to apply for permanent residence first.

You have to be very careful while applying for family sponsorship since mistakes can cause undue delay and cost you a lot in monetary terms as well.

VISIT VISA

Persons who are not Canadian citizens or permanent residents of Canada may require a visa to enter Canada. The requirement for a visa also applies to temporary residents who are transiting in Canada.

A Temporary Resident Visa (TRV) is an official document issued by a Canadian visa office that is placed in a visitor’s passport to show that he/she has met the requirements for admission to Canada as a temporary resident (either as a visitor, a student, or a worker).

If you want to visit Canada, you must obtain a Temporary Resident Visa (TRV) before your departure. According to CIC directives you cannot obtain one upon arrival in Canada.

STUDENT VISA

​Canada welcomes huge number of students from foreign jurisdictions each year. If you intend to study at a Canadian educational institution, you like most foreign nationals must apply for a study permit. A study permit, once issued, allows a foreign national to study in Canada at an approved educational institution for the duration of the specified course or program.

A Temporary Resident Visa (TRV) may also be required if the student is a citizen of a country from which Temporary Resident Visas are required for entry into Canada. However, a Temporary Resident Visa is not required for citizens of visa exempt countries.

It is possible to work in Canada, while you are here as a student, under any Citizenship and Immigration Canada’s (CIC’s) work programs for students. In addition to this, spouses or common-law partners of foreign students are eligible for a work permit for the duration as the study permit.

Upon graduation, a foreign student may apply for a work permit under the Post-Graduation Work Permit Program. Under this program, the work permit may be issued for the length of the study program, up to a maximum of three years.

WORK PERMIT

Most foreign workers require a work permit to work in Canada on a temporary basis. Before the worker may be granted a Temporary Work Permit by Employment and Social Development Canada (ESDC) an offer of employment from a Canadian employer is usually required.

There are several steps to this process. Depending upon the foreign worker’s country of citizenship, a Temporary Resident Visa (TRV) may also need to be obtained in order to enter Canada.

3: Foreign Worker applies for Work Permit

4: Work Permit is issued.

The most important of all is LMIA. Before a Temporary Work Permit can be issued, the Canadian employer who wishes to hire a temporary foreign worker may need to apply for and be granted a positive Labour Market Impact Assessment (LMIA) by ESDC, which will grant a positive LMIA if it is satisfied that there is no Canadian citizen or permanent resident is available to do the job.

STUDY PERMIT

A study permit is the official document granted by the Government of Canada that gives you permission to study in Canada. It also gives you the right to remain in Canada for the duration of the permit – one to 4 years.

You do not need a Canadian study permit if your course or program lasts six months or less. Nonetheless, it may be a good idea to apply for a permit before you come to Canada anyway – otherwise if you decide you want to continue your studies in another program, you’ll need to leave Canada to apply for a study permit through a visa office.

If you’d like to get a part-time job to help support yourself while studying in Canada, you can now qualify to work on or off-campus for up to 20 hours during university semesters and full-time during breaks such as the winter or summer holidays, without the need for a work permit.

You will also need a Social Insurance Number (SIN) from Service Canada to work in Canada or to receive benefits and services from government programs.

Your study permit will become invalid 90 days after you have completed your study program, so you’ll need to acquire a post-graduation work permit if you want to stay in Canada after your studies and seek work. This is valid for three years.
